Trademark Registration
in UAE

Your brand is one of your most valuable business assets, and in the UAE, it is unprotected until it is registered. A registered trademark gives you the exclusive legal right to use your brand name, logo, or slogan in connection with your goods and services across the UAE. Without registration, another business can legally use a name or mark confusingly similar to yours, and you have limited legal recourse to stop them.
UAE trademark registration is managed by the Ministry of Economy's Trademark Office. It is a structured legal process of trademark search, application filing, examination, publication, and registration, that takes several months to complete and requires precise classification of goods and services, accurate documentation, and correct procedural compliance at every stage.
PRO Hub manages the full UAE trademark registration process for businesses and individuals, from initial trademark search through to certificate issuance and ongoing renewal. We have protected the brands of 3,000+ businesses operating in the UAE since 2014.
Why Register a Trademark in the UAE?
Trademark registration is not just a legal formality. It is the foundation of brand protection in one of the world's most commercially active markets.
- Exclusive legal ownership – A registered trademark gives you the exclusive right to use your mark in the UAE for the goods and services covered by your registration. No other business can legally register or use an identical or confusingly similar mark in the same classes.
- Legal recourse against infringement – Without registration, enforcing your brand rights in the UAE is significantly harder. A registered trademark gives you standing to take legal action, including injunctions, damages, and customs seizure of infringing goods, against anyone who copies or imitates your brand.
- Customs protection – A UAE-registered trademark can be recorded with UAE Customs (Federal Customs Authority). This allows customs officials to detain and seize imported counterfeit goods bearing your mark at the border, without you needing to take individual legal action for each shipment.
- Commercial value and licensing – A registered trademark is an asset on your balance sheet. It can be licensed to franchisees or business partners, used as collateral for financing, and transferred as part of a business sale. An unregistered mark has no comparable legal commercial value.
- Protection in a high-counterfeit market – The UAE is a major trading hub, where goods from across the world pass through its ports and free zones. Without a registered trademark, your brand has no systematic protection against counterfeiting within this trade ecosystem.
- Priority in disputes – In any trademark dispute, the registered owner has priority. An unregistered business that has been using a name for years can still lose a dispute to a later party that registered the mark first. In the UAE, registration, not use, determines priority.
- Foundation for GCC and international registration – UAE trademark registration is a prerequisite or priority basis for seeking trademark protection across the Gulf Cooperation Council (GCC) and internationally through the Madrid Protocol system. Protecting your brand in the UAE first creates the foundation for regional expansion.
What Can Be Registered as a Trademark in the UAE?
Under UAE Federal Decree-Law No. 36 of 2021 (the UAE Trademarks Law), a wide variety of identifiers can be protected:
What CAN Be Registered
- Brand names and words: your company name, product name, or service name
- Logos and device marks: graphic elements, symbols, and visual designs
- Combined marks: a logo incorporating text (the most common type registered in the UAE)
- Slogans and taglines: distinctive phrases associated with your brand
- Three-dimensional marks: product shapes and packaging that serve a distinctive brand function
- Colour marks: specific colours or colour combinations (subject to distinctiveness requirements)
- Sound marks: audio identifiers, jingles, and brand sounds
- Certification marks: marks certifying that goods or services meet defined standards
What CANNOT Be Registered
- Generic terms describing the goods or services
- Descriptive terms with no distinctive character
- Marks identical or confusingly similar to existing registered trademarks
- National flags, official emblems, and government symbols
- Marks contrary to public order or morality
- Geographical names used in a purely descriptive sense
- Personal names without the consent of the individual concerned
- Religious terms and symbols
Pre-filing Search: PRO Hub conducts a trademark search before filing to identify conflicts with existing registrations and assess the registrability of your mark.
UAE Trademark Classification - Nice Classification System
The UAE uses the Nice Classification system, which is the international standard for classifying goods and services for trademark purposes. There are 45 classes in total: Classes 1–34 cover goods, and Classes 35–45 cover services.
Your trademark must be registered in the specific class or classes that cover your goods and services. A trademark registered in one class does not protect your brand in other classes, so a separate application and fee is required for each class.
Selecting the right classes is one of the most important decisions in the trademark registration process. Registering in too few classes leaves your brand unprotected in areas where competitors could use it. Registering in unnecessary classes wastes money. PRO Hub advises on the correct class selection for your specific business before any application is filed.
| Class | Coverage | Common Applicants |
|---|---|---|
| Class 35 | Advertising, marketing, business management, retail services | Trading companies, agencies, e-commerce businesses |
| Class 25 | Clothing, footwear, headgear | Fashion brands, apparel businesses |
| Class 43 | Restaurants, cafes, catering, hotel services | F&B businesses, hospitality groups |
| Class 44 | Medical, dental, veterinary services | Healthcare providers, clinics |
| Class 36 | Financial services, insurance, real estate | Financial services, property companies |
| Class 42 | Technology, software, IT services | Tech companies, SaaS businesses |
| Class 41 | Education, training, entertainment | Training providers, educational institutions |
| Class 16 | Printed matter, stationery | Publishing, media, education |
| Class 30 | Coffee, tea, bakery, confectionery | F&B brands, cafes |
| Class 32 | Beverages, juices | Beverage brands |
UAE Trademark Search
A trademark search is the essential first step before filing any trademark application. It identifies existing registered marks that are identical or confusingly similar to yours, and assesses whether your proposed mark is registrable.
Filing without a prior search is one of the most common and costly mistakes in trademark registration. An examiner rejection based on a conflicting mark wastes the application fee, delays your protection timeline, and, if the conflicting mark is already in use, may require you to rebrand.
What a Trademark Search Covers
- Identical marks registered in your target classes in the UAE
- Confusingly similar marks (phonetically, visually, or conceptually similar) in your target classes
- Marks pending registration (not yet formally registered but already filed)
- Well-known marks that may block registration even outside their registered classes
- Trade name registrations that may conflict with your proposed mark
PRO Hub Trademark Search Process
PRO Hub conducts searches through the UAE Ministry of Economy's trademark database and advises on:
- Whether your proposed mark is available for registration in your target classes
- Whether any existing marks present a risk of objection or opposition
- Whether your mark is sufficiently distinctive to be registrable
- Whether any modifications to the mark or class selection would improve registrability
A trademark search does not guarantee registration, as the examination process involves the Ministry examiner's independent assessment, but it significantly reduces the risk of avoidable rejections and wasted fees.
UAE Trademark Registration Process – Step by Step
We guide you through each stage of the registration process to ensure complete legal compliance:
Trademark Search
PRO Hub conducts a comprehensive search of the UAE Ministry of Economy trademark database across your proposed mark and target classes. Search results are reviewed and a registrability assessment is provided before any application is filed.
Class Selection and Strategy
Based on your business activities and the search results, PRO Hub recommends the correct Nice Classification classes for your application. Multi-class strategy is discussed where relevant, balancing comprehensive protection against application cost.
Document Preparation
PRO Hub prepares the full trademark application, including applicant details, mark representation, class specifications, and goods and services descriptions. For logo marks, a high-resolution image of the mark is required. For corporate applicants, company documents are required.
Application Filing
PRO Hub files the trademark application with the UAE Ministry of Economy's Trademark Office through the official online portal. The filing date establishes your priority date, which is the date from which your rights are calculated in the event of a dispute with a later applicant.
Formal Examination
The Ministry of Economy examiner conducts a formal examination, reviewing the application for compliance with formal requirements and assessing whether the mark meets registrability criteria. This typically takes 30–90 days from filing.
Substantive Examination
If the formal examination is passed, the examiner conducts a substantive examination, searching for conflicting marks and assessing the distinctiveness and registrability of the applied-for mark.
Examiner Objection (If Raised)
If the examiner raises an objection, based on a conflicting mark, lack of distinctiveness, or other grounds, PRO Hub prepares and files a response on your behalf. The response window is typically 30 days from the objection notice. PRO Hub advises on the strength of the objection and the recommended response strategy.
Publication in the Official Gazette
If the application passes examination (or if an examiner objection is successfully overcome), the mark is published in the UAE's official trademark gazette. Publication opens a 30-day opposition window, during which any third party who believes the mark conflicts with their rights can file a formal opposition.
Opposition Period
During the 30-day opposition period, PRO Hub monitors the publication and advises on any opposition filed. If an opposition is received, PRO Hub manages the response process, preparing submissions, coordinating with the Ministry, and advising on the merits and strategy for each opposition.
Registration and Certificate Issuance
If no opposition is filed within the 30-day window (or if any opposition is successfully resolved), the Ministry of Economy issues the trademark registration certificate. The trademark is now officially registered in your name.
Documents Required for UAE Trademark Registration
The documentation required varies based on the type of applicant.
For Individual Applicants
- Passport copy (colour scan, valid)
- Specimen of the trademark (high-resolution image file for logo marks; word mark stated in text)
- List of goods and services to be covered
- Power of Attorney authorising PRO Hub to act on your behalf (PRO Hub prepares this)
For Corporate Applicants
- Valid UAE trade license (for UAE-registered companies)
- Certificate of Incorporation (for foreign companies)
- Specimen of the trademark
- List of goods and services to be covered
- Power of Attorney authorising PRO Hub to act on your behalf
Foreign Companies Applying Without a UAE Entity
Foreign companies can apply for UAE trademark registration without having a UAE trade license. The application is filed in the foreign company's name directly. PRO Hub advises on the documentation requirements for foreign corporate applicants.
Priority Claims
If you are claiming priority based on an earlier foreign trademark application (within 6 months of the earlier filing under the Paris Convention), you need the priority application details and a certified copy of the earlier application.
Trademark Renewal, Assignment, and Licensing
Trademark Renewal
A UAE registered trademark is valid for 10 years from the filing date and must be renewed to remain in force. Renewal can be filed from 12 months before the expiry date. A grace period of 6 months after expiry is available with a late surcharge. Failure to renew results in the trademark lapsing, resetting your priority date and leaving your brand exposed. PRO Hub manages renewal monitoring and filings.
Trademark Assignment
Transfer of ownership of a registered trademark from one party to another (in a business sale, restructuring, or brand acquisition) must be recorded with the UAE Ministry of Economy to be legally effective. PRO Hub prepares trademark assignment agreements and manages the recordal process.
Trademark Licensing
A trademark owner can grant third parties (franchisees, partners) the right to use the mark under defined conditions. Licensing agreements should be recorded with the Ministry of Economy. PRO Hub advises on licensing structures and handles registration.
Customs Protection Recordal
A registered UAE trademark can be recorded with the Federal Customs Authority so officials can actively seize infringing imported counterfeit goods bearing your mark at the border. PRO Hub manages this customs recordal.
Trademark Infringement and Enforcement in the UAE
If your registered trademark is being infringed, such as by a competitor using a confusingly similar name, logo, or mark without your authorisation, you have several enforcement routes in the UAE:
- Civil action – File a civil lawsuit before the UAE courts seeking an injunction to stop the infringing use, damages for loss suffered, and destruction of infringing goods.
- Criminal complaint – UAE trademark law provides for criminal penalties, including fines and imprisonment, for deliberate trademark infringement. A criminal complaint can be filed with the police or the Ministry of Economy's IP enforcement unit.
- Ministry of Economy complaint – The Ministry of Economy's IP Department investigates trademark infringement complaints and can take administrative action, including raids on businesses selling counterfeit goods.
- Customs seizure – If your trademark is recorded with UAE Customs, officials can seize infringing imported goods at the point of entry, providing a fast, cost-effective border enforcement mechanism.
GCC and International Trademark Protection
A UAE trademark registration protects your brand only within the UAE. If your business operates across the GCC or internationally, you need to consider trademark protection in each relevant market.
GCC Trademark System
The GCC Trademark Office issues a single trademark registration covering all six GCC member states (UAE, Saudi Arabia, Kuwait, Qatar, Bahrain, and Oman) through a single application process. A GCC trademark is an efficient route to regional brand protection. PRO Hub files GCC trademark applications and manages the process end-to-end.
Madrid Protocol (International Registration)
The UAE is a member of the Madrid Protocol, the international registration system administered by WIPO. A UAE trademark registration can be used as the basis for an international application, extending protection to any of the 130+ member countries through a single application filed through the UAE Ministry of Economy. PRO Hub advises on international strategy and handles WIPO filings.
Individual Country Filings
For markets not covered by the GCC system or Madrid Protocol, or where a specific national registration strategy is preferred, PRO Hub coordinates country-specific trademark filings through its network of international trademark agents.
Trademark vs. Trade Name - What Is the Difference?
This is one of the most common points of confusion for UAE business owners:
Trade Name
A trade name is the registered name of your company, which is the name on your trade license, issued by ADDED, DED, or relevant licensing authorities. Trade name registration is part of the company formation process and gives you the right to use that name as your business name within the specific emirate or free zone.
Trademark
A trademark is registered with the UAE Ministry of Economy and protects your brand assets (name, logo, slogan) in connection with specific goods and services. Trademark registration gives you exclusive nationwide IP protection that trade name registration alone does not provide.
Why You Need Both
Having a trade license with a registered trade name does not give you trademark protection. Another party could register a confusingly similar trademark and legally prevent you from using your own brand in commercial activities. PRO Hub advises all businesses to pursue trademark registration alongside or shortly after trade name registration.
Can a trade name conflict block a trademark application? Yes, under certain circumstances. Trade names registered with mainland authorities may be cited as conflicts in trademark examination. PRO Hub's pre-filing search covers both trademark and trade name registrations.
Why Choose PRO Hub for UAE Trademark Registration?

- Class Strategy Expertise – Correct class selection is the most consequential decision in trademark filing; PRO Hub maps your business activities to the right classes before any application is filed.

- Zero Hidden Costs – Official fees and PRO Hub service fees quoted in full before any work begins; no surprise invoices at the registration certificate stage.
